Terms of Service
Effective date: September 4, 2026 · Version 1.3
1. Who we are / acceptance
browselenium.online ("the Service") is operated by morawski.my from Poland ("we", "us"). The Service's infrastructure — including the cloud browsers — is hosted in the European Union, in Germany. By creating an account, using an API key, or connecting to the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. The service
The Service provides programmatic access to automation browsers (real, human-like browser sessions running in the cloud) over the Model Context Protocol (MCP), for use by software agents. Plans and limits (requests per day, maximum browser session lifetime, available features) are published on the pricing page and enforced automatically. We may change plans, limits, or features; material adverse changes to paid plans will be announced in advance where practical.
3. Accounts and API keys
- You must provide an accurate email address and are responsible for keeping your credentials secure.
- API keys are your responsibility. Treat them as secrets; anyone holding your key consumes your quota. Rotate a key immediately from the dashboard if it leaks.
- One primary account per person or organization unless we agree otherwise in writing.
4. Acceptable use
You agree NOT to use the Service to:
- break any applicable law or regulation, including data-protection, computer-misuse, and anti-spam laws;
- access systems or data without authorization, bypass authentication you are not entitled to bypass, or commit fraud;
- conduct credential stuffing, brute-force, or other attacks against any site or service;
- transmit malware, spam, or deceptive content, or build products whose primary purpose is abuse of third parties;
- knowingly use the Service against sites where you are not permitted to automate access, or in ways that cause harm to those sites;
- harass, defraud, or infringe the rights of others;
- resell, sublicense, or share access to the Service without a separate written agreement with us;
- probe, scan, or interfere with the Service's own infrastructure, or circumvent its usage limits.
You are responsible for how you (and the agents you connect) use the Service and for complying with the terms of any third-party website you visit through it. We may suspend or terminate accounts for violations of this section, with or without notice where required to prevent harm.
Abuse prevention. Free-tier traffic passes automated abuse checks: we track the IPs requests come from and compute a per-IP heat score based on request bursts, failed key authentications, and key farming. Requests from IPs with a high heat score are rejected until the score cools down, and affected accounts are notified on their dashboard. Paid plans are not subject to IP-based heat restrictions — VPNs, proxies and shared egress are fine for paying users.
5. Logging, automated screening, and law-enforcement disclosure
Request logging. For abuse prevention and legal compliance, every request made through the Service is recorded in an audit log and kept for 30 days. Each entry ties the request to the account that made it: the account email address, the account identifier, the API key used (stored hashed), the timestamp, the source IP address, the user agent, the tool called, and the outcome (allowed or refused, with the reason). Blocked navigation attempts additionally record the requested URL and the category of the violation.
Automated screening. Navigation requests through the hosted Service pass an automated screen for destinations associated with clearly illegal activity — for example sexual abuse of minors, violence-for-hire, weapons and explosives instructions, terrorist recruitment, illicit drug markets, stolen financial data, or malware and attack-for-hire services. Blocked attempts are refused, logged with the identity of the account that made them, and may lead to suspension or termination under section 4.
Retention and disclosure. Audit entries are deleted automatically after 30 days, unless we must preserve them (for example under a legal hold or an ongoing investigation). By using the Service you expressly consent to this logging, to these retention periods, and to disclosure of audit records to law-enforcement authorities, courts, or other competent bodies upon valid legal process under Polish and EU law — or where we believe in good faith that disclosure is necessary to prevent imminent harm, protect children, or respond to an emergency involving a risk of death or serious injury. If you want activity on your account to stay private, do not use the Service for it.
6. Paid plans, billing, cancellation
- Paid tiers are billed monthly in advance through Stripe. Subscriptions renew automatically until canceled.
- You can cancel anytime from the Stripe checkout/portal; cancellation takes effect at the end of the current billing period, after which the account reverts to the free tier.
- Refund requests within 14 days of a charge may be considered case-by-case at [email protected]. Abuse-based terminations are not refunded.
- Prices may change with at least 30 days' notice; the change applies from your next billing cycle.
6a. Public proxy routing
On request, a hosted browser session can be routed through a shared public proxy drawn from a pool of free, community-maintained proxies that the operator refreshes and health-checks periodically. This option exists for scraping and testing from a different network position - not for privacy or security.
- Shared, untrusted infrastructure. Public proxies are operated by unknown third parties. Anything you send while routed - credentials, tokens, cookies, personal data - is visible to the proxy operator and anyone on the path. Never use public-proxy routing for logins, payments, or anything you would not send over an open network. You assume full responsibility for traffic sent through these routes.
- No destination guarantees. We do not control where a public proxy egresses from, and target sites may block, captcha, or geo-shift these routes. Success rates vary hourly by design of the public-proxy ecosystem.
- Failure handling and quota. If a routed route cannot reach the web, the service silently retries with a different proxy (the specific proxy is never disclosed). You are charged a request only when a routed session actually starts; failed routing attempts do not consume quota.
- Fair-use limits. Routing attempts are capped per start (the service will report failure after several tries), routing may be rate-limited per account to protect the shared pool, and the operator may restrict, throttle, or discontinue public-proxy routing at any time - including on accounts whose traffic through shared proxies violates section 4.
- No anonymity. Your account and API key remain attached to every routed request (see section 5). Public-proxy routing does not anonymize you against the operator, and it must not be used to evade bans, circumvent section 4, or shift abuse onto third-party networks.
7. Availability and changes
The Service is provided without an uptime guarantee. Target websites change, bot defenses change, and automation is inherently fallible: we do not warrant that the Service will succeed against any particular site or challenge. We may add, modify, or discontinue features and may impose rate limits or capacity constraints at any time.
8. Termination
You may stop using the Service at any time. We may suspend or terminate your access for breach of these Terms, non-payment, or to protect the Service or others. On termination your API keys stop working and your quota resets to zero.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amounts you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or costs of substitute services, even if advised of the possibility. Some jurisdictions do not allow certain limitations; in that case these limits apply to the fullest extent permitted.
11. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms or the rights of any third party.
12. Governing law and disputes
These Terms are governed by the laws of Poland, excluding its conflict-of-law rules. The courts of Poland have exclusive jurisdiction over disputes, unless mandatory consumer-protection law provides otherwise.
13. Changes to these terms
We may update these Terms by posting a new version on this page with a new effective date. Continued use of the Service after an update constitutes acceptance.
